Disputes arise out of commercial relationships and transactions whether as a result of direct breach of contract or due to interpretation of contracts and instruments. There are a myriad of issues upon which disputes arise under business and commercial practise from the operations of sole proprietorships, joint ventures, partnerships, and public private partnerships, reconstructions or mergers and dissolutions, securities, accounting, taxation, and regulated industry law.
Our commercial litigation department has honed its skills in commmercial civil litigation and have represented banks and individuals on either side where disputes have arisen on loans and credit advances and in causes of action arising from company formation and shareholding structure, interpretation of contracts, breach of contracts, sale of goods, and generally all aspects of labour relations.
Defamation is "the intentional and wrongful publication and communication of words or behavior to a third party which has the effect objectively viewed of injuring a person or entity's reputation". The law guarantees everyone the right to a good name, thus a person's or legal entity's reputation is something that is nurtured over a long period of time as a result of extreme hard work, dedication and commitment. This reputation can be destroyed in an instant by the intentional or reckless action of another person. The defamation may be published through any public media including; television, radio, print media, and the Internet. When defamation of character occurs, a claim for damages for libel or slander can be founded and the courts would award damages aimed at least in part at providing the victim of defamation with some degree of monetary compensation for the damage to reputation.
We are specialist defamation attorneys and for over 20 years have represented top media houses and continue to do so. Our services in this area of law involves advising clients on whether defamation has occurred, formulating claims, launching defamation suits when we represent the plaintiff and defending defamation suits when we represent the media. In defending defamation suits, we determine the best form of defence among any of the known ones such as Privilege, Truth and public interest, Fair comment, Provocation and Consent. We have been successful in several suits employing the defence of Justification (Truth and public interest)
We advise clients on the best course to take in divorce/judicial separation issues including settlement of property, custody and visitation rights.
